Can I Terminate My Lease If The Landlord Added New Mandatory Parking Fees Not In The Contract?
Location: Georgia
Hi all, I’m in Georgia and my apartment complex just announced a new parking system with fees, towing threats, and registration requirements that were never in my signed lease.
Currently my lease doesn’t contain:
• parking fees
• permit system
• clause allowing mid‑lease financial/material changes
Based off the email sent, management is now saying I must:
• Register with a third‑party vendor
• Pay new fees
• Risk towing if I don’t comply
• Accept new rules that were not part of the lease I signed
From what I understand, a landlord can’t unilaterally add new obligations or fees without a lease amendment and my consent. This seems like a material breach of the lease on their part.
My questions:
- Under Georgia law, does this qualify as a landlord breach that allows me to terminate the lease?
- If I give written notice of termination for landlord breach, am I allowed to move out and stop paying rent after my notice date
, as well as the fee for early termination?
- I guess what are my general options?
Any guidance or similar experiences would help. I wanted to post here before I probably will reach out for legal aid.
