Called A Locksmith To Make A New Car Key, Ended Up Breaking My Car And Not Making Me A Key

Location: Texas ,Title explains it simply, my car is a Nissan Altima touch to start, so no key just a key fob ; I lost the key for 2 days and decided getting a new one is cheaper than Uber, the locksmith company I called said it would be a 45 minute job, came over and started working immediately, I didn’t sign anything or was intormed of any risks with the procedure. After 3 hours he was unable to make me a key fob, so I called another company, that guy came , plugged his programming tablet in and immediately said whoever was here last messed up the programming because nothing was normal. The next day I had the car towed to a dealer and they spent 6 hours trying many different things and eventually concluded the BCM is broken, the bcm is what communicated between the car and the key fob(simply) and they said it was soft locked somehow and I would need a new one. From what I’ve seen online a bcm can get soft locked by incorrectly programming it with an aftermarket programmer or aftermarket key fob. And I know for a fact it wasn’t broken before or I wouldn’t have been driving my car before the keys got lost. I have a feeling he knew he broke it because he left without telling me when he would come back; and his company started dodging my calls. But luckily I know where their storefront is

Do I have a case against the first locksmith to make him pay for a new one since his company broke it according to the dealer and 2nd locksmith?

Worst part is , I ended up finding my key but it didn’t work at all after what the 1st guy did.
