Am I Required To Give 30 Days Notice In An At Will State?
Location: Georgia- I started working for this company 4 days shy of a month now and i was called from my previous employer stating they have a job opening that they would like to hire me for. They are working things out for the position and i should hear something this week regarding a start date. I do not like the position i am in now and have been trying to get back to my previous employer (laid off due to RIFF almost 6 months ago). I know that the company will want me to start in two weeks once they let me know that it's for sure mine. In my employment agreement it says that there is a 30 day notice policy if the employee resigns. I am still in my 2 month probationary period as well. Towards the bottom of the agreement is says if the agreement is breeched, they can terminate or sue for irreparable harm of up to $999,999 plus... i spoke with a manager of a lawfirm and without him looking at it he said it isn't enforceable and it would cost them more to sue me than what they would get out of me, but he isn't a lawyer so ????????♀️ My question is, if i get the job and tell them i can only give 2 weeks can they really do anything if i am in an at will state?
