Affidavit Of Fact For An Aggravated Assault With Deadly Weapon Charge?
Location: Texas.
Here recently my boyfriend and I got very VERY intoxicated and ended up in a not physical fight. I was trying to leave and he was in the process of moving a gun to another room (we both have history of suicidal tendencies), when I came in and freaked out and tried taking it from him. He then said “it’s going to be a murder suicide”, referring to me trying to take a gun out of his hands, not as a threat but more as a hey chill out you’re going to kill us both (he was unloading the gun and I misinterpreted it as him loading it.) Of course, being under the influence I heard that and called the cops and that leads us to today.
I signed an affidavit of non prosecution with his lawyer, but have gotten advice from some people to do an affidavit of fact/truth, however whenever I looked into it it seems mostly pertaining to things such as car sales etc. Would it be beneficial for this situation, or would it cause more harm? Also, what can I do as the alleged victim to get charges dropped or at the least even reduced?
